Part # 5166.01302 does have a locating finger that your bike doesn't have. Other than that the picture and diagram look very similar, except that parts 5166.01201 and 5166.01302 are in reverse order.
Did they make such a significant change between 1980 and 1983? Is this possibly where your problem lays, have you got these two parts fitted in the wrong order, just a thought.
I have the 349/4 parts manual but it's exactly the same as the diagram you posted, you need to find a 1980 parts manual which I'm sorry I don't have.

PS:- I've never had a Montesa engine apart yet, but I will soon (349/4).

this change was 1979-1980 and i have the correct part as my casing in my 1980 doesn't have a hole for the post where as the 79 has the post. My problem is trying to work out how they made the different mechanism fit and work properly. Wether packing it out as I have done will effect the transfer of oils between gearbox and clutch will it wear the housing faster being packed with a 5mm spacer, if I ground some meat off the protuding bolt will the cogs line up all these little questions I'm currently thinking that I should just use it as is and see if it works ok. The biggest question is was it put together like this in the factory? the selector shaft (1980) has 1.75mm free play where as the 1979 has only a fraction of sideways movement.............hmmm that is an interesting thought. can they fit the wrong way around and still work?

Rod your a clever bastard, thank you :D ....Bugger it's gotta come appart again. :( :montesa ----No it doesn't come apart again and thank you Rod for getting me thinking hard about this and then being able to reason why there Is a difference between early and late cotas.

This also shows the difference between 1979 and 1980 model.

I think I have it set up correctly. In the manual there is a spacer behind the gear shaft this must be to compensate for the change in the position of the shift plate. :D I don't have to pull it apart again.

First off, in the states, we refer to the 1st model of the 349 as a 1980 model. (the fuel tank had the fuel level indicator) the 80' model used the same shift components
as the 79' Cota 348. This had the fixed post, screwed into the case for the return spring. Very late 1980 and 81' models used the 5166.01302 plate that had a tang
that took the place of the screwed in spring post. Only other change was the shift shaft. 1980 models used the 7366.118 shaft (this is the mx shift shaft) Later models
used the 5166.118 shaft. This later shaft had the spring post hole mounted in a different spot to take in account the different spring mounting on the plate tang.
Mixing the two shafts will put the 0266.014 spring in the incorrect location to work correctly.
Later shift assemblies also used a washer (5166.138) behind the 2166.03601 shift mounting to slightly space out the shifter. Also there was a bushing (5166.137)
that went between the plate with the tang and the case. Both pictures are correct. Later models with the spring tang on the plate were mounted on top of the selector plate.
(plate with the teeth) opposite of the 1980 model. Hope this helps.}

Has anyone got a photo of the wiring setup inside the headlight to assist me with my wiring diagram or any other piece of wiring on the 1980 montesa Cota 349.

Just a note about chain length the chain I fitted was from a 247 cota with 10T to a 64T rear sprocket this was the exact length required for an 11T to a 44T on the late series one 349 Montesa Cota.
