EXISTING USAGE RIGHTS - Most people, mainly Victorians would be aware of the "Save Barrabool's McAdam Park" campaign which has been in operation for some years. Well, as you may well know through the assistance of MA and Government grants the properties ownership was secured.
We (members of Sporting Motor Cycle Club) are writing in an effort to flush out as much information on prior use as we can. Facing forceful objections from several local land owners (who are new to the area) we are threatened with the possibility of losing riding rights on this iconic property and we need documentation from YOU, the riders and supporters of motorcycling to prove prior usage of motorcycling on the property.
To absolutely prove that we actually held the events at McAdam Park, we must have more information to give to our solicitors or else the unthinkable may happen; this being a negative ruling at the scheduled VCAT hearing in January 2011.
Information on the last 20 years is needed the most, including any events that were held off the MX track (pony express, Trials etc); there were heaps of them! Seeing as most people do not have photos or records of old events, we ask that if you were at one of them, please go to the trouble of making a ‘statutory declaration’ (forms attached below) and sending it to the club. All you have to do is recall what you can remember and put it in words – try put in dates (or approx.), event type, where on the property and what happened on the day, perhaps mentioning other people who were there if you remember.
THE ABOVE IS VITALLY IMPORTANT!
Our solicitors cannot prove historic events using just hearsay, we need black and white evidence!
50 stat decs holds a whole lot more weight than 5! Spread the word amongst your friends, our riding future is in your hands. Please help before it is too late!!
In summary, if you have ever ridden at Mc Adam Park, competed at, in any sort of motorcycle event, been to schools or clinics held on the property, or have attended any event as a spectator we need your help, no matter how big or small the event was. Info from past and present trials riders is especially sought as we commonly used the gully down the lower end of the track which is under a heavy threat. If you need assistance in completing the document please email us and ask, we will be more than happy to assist you.
On a brighter note we are holding a small trial on the property this coming Sunday, Nov 14th. It is also open track day for those that would like to have a rap around the track on their dirt/motoX bike (fee's and conditions apply, refer to SMCC web site for details). For those that are attending this weekend perhaps you could bring your stat dec and photo's, video's (anything) with you, we will return all images to you.
Any inquiries please forward email to [email protected]
or alternatively post info to SMCC Trials at PO Box 15, Inverleigh, Vic, 3321
The Statutory Declaration forms below are from the Victorian Justice department. For information on who can witness a stat dec, refer to the list at this link.
